Can a Landlord Enter Without Permission in Ohio?

In Ohio, a landlord’s right to access is governed by Ohio Revised Code § 5321.04(A)(8). Generally, a landlord cannot enter your unit without permission except in very specific circumstances.

Notice Requirements

For non-emergencies (inspections, repairs, or showing the unit), the landlord must:

  • Provide reasonable notice, which is legally presumed to be at least 24 hours.

  • Enter only at reasonable times (typically normal business hours).

When Permission is NOT Required

A landlord may enter without a tenant’s immediate consent only if:

  • Emergency: To prevent immediate damage to property or life (e.g., a burst pipe, fire, or gas leak).

  • Impracticability: If it is “impracticable” to give notice under the circumstances.

  • Tenant Absence: If the tenant has abandoned or surrendered the premises.
