The maximum duration of a standard residential lease in Texas is one (1) year. All tenancies for one year or longer require a written lease agreement.
Oral leases are permitted in Texas for leases shorter than one year, but it is recommended that all lease agreements be in writing. Not only are written leases easier to defend and enforce, but landlords are required to provide the tenant with a copy of the rental agreement within three days after it is signed.
Using a written lease can make the rental process smoother for both parties.
