Yes, subletting is legal in Texas; however, if the lease agreement does not address (or prohibits) subleasing, then tenants must obtain the landlord’s written permission to sublet. Otherwise, the landlord has the right to evict the subtenant and sue both the tenant and subtenant for damages.
