In West Virginia, to file an eviction notice you first serve the tenant with a written notice to vacate, usually giving at least 30 days. If the tenant does not leave, you file an unlawful detainer action in the local magistrate court, pay the filing fee, and serve the tenant with a copy of the complaint. If the court rules in your favor, the sheriff enforces the eviction.
