
The maximum duration of a standard residential lease agreement is one (1) year in Nebraska. Oral leases are valid for shorter durations, but leases for one year or longer need to be in writing (NE Code § 36-105).
Oral leases are difficult to prove and enforce, so it is recommended that all leases be in writing regardless of duration. If there is no fixed term defined in the lease, the tenancy is considered month-to-month unless rent is paid weekly (NE Code § 76-1414 (2019)).
