In Nevada, in order for the delivery of a lease termination or eviction notice to be legal, certain rules and procedures must be followed. If they are not and the case proceeds to court, the case may be postponed or dismissed by a judge.
Who Can Serve Eviction Notices in Nevada?
In Nevada, landlords cannot serve eviction notices and lease termination notices themselves. Landlords must hire a sheriff, constable, licensed process server or agent for an attorney to serve an official notice.
When Can Eviction Notices Be Served in Nevada?
In Nevada, lease termination and eviction notices are served as soon as the sheriff, constable, process server or agent for an attorney is available.
For a 4 or 7 Day Notice to Quit, the eviction notice used for tenants that did not pay rent in full and on time, a landlord can serve notice the day after rent is due. There is no legal grace period for paying rent in Nevada, rent is late starting the day after it’s due.
Acceptable Forms of Service in Nevada
A sheriff, constable, licensed process server or agent for an attorney shall deliver notices in Nevada using any of the below acceptable methods:
- Handing the notice to the tenant in person;
- Handing the notice to a person of suitable age and discretion AND mailing the notice by overnight mail;
- Posting the notice in a conspicuous place at the premises AND mailing the notice by overnight mail.
Obtaining Proof of Service in Nevada
The sheriff, constable, licensed process server or agent for an attorney will complete the Declaration of Service for proof of service in court.

“Day of service” means the day notice is delivered to the tenant. If personal service was not so delivered, the “day of service” means the day the notice is delivered, after posting and mailing pursuant to subsection 2, to the sheriff or constable for service if the request for service is made before noon. If the request for service by the sheriff or constable is made after noon, the “day of service” shall be deemed to be the day next following the day that the request is made for service by the sheriff or constable.
If the notice cannot be delivered in person, then post a copy of the notice in a conspicuous place on the premises and mail the notice by overnight mail.
