
In Indiana, the maximum duration of a residential lease agreement is three (3) years. Leases longer than three years must meet certain additional requirements.
Leases longer than three years must be written. Verbal leases are valid for shorter leases, but it is recommended that all leases be written regardless of duration. Verbal leases are more difficult to prove.
Leases with a duration of longer than three (3) years must be filed in the county recorder’s office (IN Code § 32-31-2-1 (2019)). This must be done within 45 days of its execution, or it is considered void (IN Code § 32-31-2-2 (2019)).
